Commissioner Ameermia assess the situation in Sibuyile Informal Park

On 24 May 2015, during his provincial visit in the Free State Province, Commissioner Ameermia accompanied by the staff of the SAHRC conducted a site visit to Sibuyile Park Informal Settlement. This was a follow up from the visit conducted by Commissioner Ameermia in September 2015 where he met with community members of the informal settlement. The matter stems from an investigative report issued by the SAHRC where it found that inter alia, there was a violation of the right of residents to dignity; a clean environment; access to adequate housing; access to adequate water and sanitation; and access to information.

Section 17 of the South African Constitution recognises the right in the following terms “[e]veryone has the right, peacefully and unarmed, to assemble, to demonstrate, to picket and to present petitions”. Often we refer to this right as the right to protest.

20 years of the Constitution

17 May 2016

By Advocate Shafie Ameermia, SAHRC Commissioner responsible for Access to Justice and Housing.

On 8 May 2016, the whole country remembered with fond memories the day when the Constitutional Assembly 20 years ago adopted the Constitution which would be the blue print of our country. However, as was noted by Mr. Cyril Ramaphosa who at the time was the Chairperson of the Constitutional Assembly, “[T]he real legacy of the Constitutional Assembly is not merely in the books that will be distributed, it lies in the growing awareness of what a Constitution means.
