Media Advisory: City of Ekurhuleni Mayor Mzwandile Masina to Sign Settlement Agreement Following Hate speech Allegations

In April 2017 the South African Human Rights Commission (The Commission) received several complaints, namely, from Mr. Michael Biribauer, Mr Shane Opperman and Mr Daniel van der Heever, in their capacity as concerned private citizens and Advocate Anton Alberts, in his capacity as a Member of Parliament, representing the Freedom Front Plus Political Party against the Mayor of the City of Ekurhuleni, Cllr. Mzwandile Masina.

The Complainants alleged that on 10 April 2017, while Masina was delivering a speech to commemorate the late Chris Hani, he made the following statements towards to white South Africans:
•    “It is very important that we send a very strong warning that we will crush any individual who stands in the way of the project of nation building and social cohesion in South Africa”;
•    “It might be very rough and we are many, this is not a threat, we are many, it might be very rough”
•    “I want to say to our white counterparts in South Africa, they must be very careful”;
After engaging with the Complainants and the Respondent, the Commission determined that this matter would best be resolved through a process of mediation. The Commission sent invitations to mediate to the Complainants and to the Respondent. The Respondent advised the Commission that he was willing to subject himself to the mediation process facilitated by the Commission. Of the three Complainants, only Michael Biribauer agreed to attend the mediation session.

During the mediation process both parties were given a platform to recount their version of events and upon the conclusion of the mediatory discussion various terms of settlement were reached. These terms have given rise to a settlement agreement to be signed by the parties.  
The Commission invites members of the media to the ceremonial signing of the settlement agreement.
