Media Statement: SAHRC clarifies its position on land expropriation

The South African Human Rights Commission wishes to clarify its position on land expropriation following misleading press reports published in various media today to the effect: “SAHRC opposed to land expropriation without compensation”.

The SAHRC’s position on land expropriation without compensation, as contained in its submission to the Constitutional Review Committee today (6 September 2018), is that the Commission supports the expropriation of land without compensation through legislative amendment, but not through the amendment of the Constitution.

The Commission proposes that in addition to addressing the significant issues in land reform as expounded in its submission, government pursues a legislative route in order to expropriate land without compensation in appropriate circumstances.
