Media Advisory: The South African Human Rights Commission is calling for Submissions on allegations of racial discrimination at SuperSport

21    February 2019

Attention: Editors and Reporters
In May 2018, the South African Human Rights Commission (“The Commission”) was made aware of an incident where Mr Ashwin Willemse walked off the set of a live broadcast at SuperSport studios allegedly after a verbal clash with two rugby analysts, Mr Nick Mallett and Mr Naas Botha. Following the incident, SuperSport appointed Advocate Vincent Maleka SC to conduct an independent review of the cause(s) of the statements and the resultant walk out by Mr Willemse.
On 18 June 2018, Maleka SC issued a report entitled “Report on the review of the altercation that took place at Studio 1 of SuperSport on 19 May 2018” in which he found that there was no “naked racism” on the part of Messrs Botha and Mallett. He further found that there was no subtle racism that motivated the conduct of Mr Willemse. In his report, Adv Maleka recommended that SuperSport should take the initiative to refer Mr Willemse’s allegations of racism to the South African Human Rights Commission for final resolution.

After careful assessment of the independent report and following media reports and interviews in which SuperSport was accused of racism and victimisation, the Commission has determined that it will hold an investigative inquiry into the allegations in this matter. The Commission has deemed it appropriate and in the public interest to broaden the scope of its investigation to probe other allegations of racial discrimination at SuperSport which fall outside the scope of Maleka SC’s independent review.

Employees and independent contractors (former and current) at SuperSport, and other interested parties are invited to make written submissions to the Commission in order to fully address the issues for investigation.
Written submissions must reach the Commission by Friday, 31 May 2019.
