Lenasia: SAHRC registers court victory over demolitions

The South African Human Rights Commission and the residents of Lenasia today registered a victory in the South Gauteng High Court after the court issued an order that there will be no further demolition of houses in Lenasia, south of Johannesburg.


Deputy Judge President Mojapelo postponed the matter to allow the parties to engage in a process to find an amicable solution to the dispute and for the parties to commit themselves to this process. The provincial government  undertook to halt all demolitions in the Lenasia area.

The provincial government will, if there is a need, file a further affidavit in court. Any party may approach this court to set the matter down for a hearing. Both parties  will use their best endeavors to discourage illegal invasions.

The South African Human Rights Commission continues to support an approach grounded in dialogue. We believe that an amicable solution will be found to urgently address this matter.

A mediated approach recognises that our legal framework is built on the values enshrined in the Constitution which are reflective of our history and struggle as a country. We have always emphasized that the extreme action adopted by the Gauteng government disregards these Constitutional values and therefore makes a mockery of human rights.

The Commission will further continue to fight to protect the human rights, including the right to housing, of vulnerable groups, especially women, children and people with disabilities.
