Media Statement: South African Human Rights Commission remains responsible for the Promotion of Access to Information Act until 2021

The South African Human Rights Commission welcomes the proclamation of various sections of the Protection of Personal Information Act 4 of 2013 (POPIA) by the President on 22 June 2020. In terms of the proclamation, sections 110 and 114(4) of the POPIA will commence on 30 June 2021. These sections of the POPIA will amend the Promotion of Access to Information Act 2 of 2000 (PAIA) and further enable the handover of PAIA functions from the Commission to the Information Regulator.

In particular, section 114(4) of the POPIA provides that “the South African Human Rights Commission must, in consultation with the Information Regulator, finalise or conclude its functions referred to in sections 83 and 84 of the Promotion of Access to Information Act, as soon as reasonably possible after the amendment of those sections in terms of this Act”. The Commission will therefore continue to work with the Information Regulator to ensure a smooth handover of PAIA functions by 30 June 2021 or as soon as reasonably possible thereafter.

The Commission wishes to inform all stakeholders that it will continue to discharge its powers and functions under the PAIA until the handover process to the Information Regulator is complete. The Commission will also inform its PAIA complainants and enquirers of transitional arrangements during 2021.

The Commission wishes the Information Regulator well as it commences its broad functions under the POPIA and looks forward to working together to promote and realise the constitutional rights to privacy and access to information.
