Section 4(3) read with Section 22(a) of the SAHRC Act makes it a criminal offence if a person fails to comply with a subpoena notice issued in terms of section 15(1) of the SAHRC Act. Furthermore section 181(4) of the Constitution makes it clear that no person or organ of state may interfere with the functioning of Chapter 9 institutions.
The issuing of the subpoena notice was intended to secure the attendance of the Municipality before the Commission and to compel the Municipality to provide the Commission with information concerning plans to make public buildings under its jurisdiction accessible to people with disabilities.
