Media Statement: Subpoena proceedings against the Administrator of Dr JS Moroka Municipality

The Administrator of Dr JS Moroka Local Municipality (“Municipality”), Mr B.M Mhlanga (“Mr Mhlanga”), previously failed to attend subpoena proceedings scheduled for 11 November 2020 by the South African Human Rights Commission (“Commission”), necessitating the laying of criminal charges against him in terms of section 22 of the South African Human Rights Commission Act 40 of 2013. The subpoena proceedings related to the investigation of a complaint regarding water access challenges within the Municipality.

Mr Mhlanga has since appeared before the Commission on 22 January as well as 5 and 15 March 2021 and provided written submissions on the matter. The subpoena proceedings in respect of the Municipality have now been concluded.

The investigation of the matter, however, continues with the view to ensuring accountability and securing appropriate redress for the affected residents.  A report of the Commission’s investigative findings will be made available after the conclusion of the investigation.
