Media Advisory: SAHRC Eastern Cape Provincial Office to conduct an Inquiry into the Right to Basic Education and Regulation of School Uniforms

The South African Human Rights Commission in the Eastern Cape Provincial Office call for Submissions on Allegations of the Over-regulation of School uniforms and Access to Basic Education.

From media reports and complaints received by the ECPO learners have been subjected to alleged victimisation and discriminatory treatment as a result of wearing religious, cultural and traditional accessories. The victimisation has extended to learners wishing to exercise autonomy by choosing to wear natural hairstyles such as longer hair, an Afro hairstyle, and dreadlocks. Furthermore, the regulation of the appearances and uniforms of learners have also adversely impacted on the rights of transgender and gender-non conforming learners who are unable to freely choose uniforms which may better suit their gender identity.

From the above, it appears that the perceived over-regulation of the appearances and uniforms of learners may constitute towards a violation of their equality, dignity, freedom of expression, best interest as well as basic education rights.

Against this background, the ECPO intends to ventilate these pertinent issues during a Provincial Inquiry on the 14th, 15th and 16th of March 2022 in Gqeberha, Eastern Cape. Concerned members of the public, interested stakeholders and interest groups are encouraged to contact the ECPO to express interest in participating and making submissions during this Inquiry.

The Commission remains vigilant in safeguarding the rights of learners and underscores the need to ensure that learners are able to access education without discrimination. The aim of the planned inquiry is therefore to ventilate these matters accordingly.
