Media Advisory: SAHRC Eastern Cape Provincial Office to conduct an intervention on the implementation of Section 34(1)(d) of the Immigration Act 13 of 2002

From observations during monitoring conducted at detention centres, the Eastern Cape Provincial Office (ECPO) of the South African Human Rights Commission (SAHRC) has noted that undocumented detainees are not afforded an opportunity to appear before presiding officers in person when extensions of court warrants in terms of Section 34 (1)(d) of the Immigration Act 13 of 2002 and Section 34 of the Constitution are considered.
Accordingly, and in order to empower relevant stakeholders, the ECPO will hold an intervention in the form of a dialogue on the implementation of Section 34 (1)(d) of the Immigration Act 13 of 2002.

The dialogue engagement will be held as follows:

The dialogue will include participants from multiple sectors, including district and provincial government departments.  The SAHRC underscores the importance of safeguarding the rights of asylum seekers, refugees and immigrants and emphasizes the need to ensure that affected parties are able to access justice through the enforcement of due process, and without facing unfair discrimination. The aim of the planned dialogue is therefore to ventilate these matters accordingly.
