Media Advisory: SAHRC Eastern Cape to host a stakeholder engagement on the functionality of Equality Courts in the Eastern Cape

Equality courts are specialised courts designated to hear matters relating to unfair discrimination, hate speech and harassment. In terms of the Promotion of Equality and Prevention of Unfair Discrimination Act 4 of 2000 (PEPUDA) the South African Human Rights Commission (“Commission”) has a mandate to assist complainants in bringing complaints to the equality courts, to conduct investigations into cases and advise complainants.

The SAHRC Eastern Cape provincial office has received several complaints and assisted complainants on a variety of equality matters relating to discrimination based on race, disability, religion and sexual orientation. It has further conducted monitoring of a sample of equality courts in various districts in the province. During these interventions, various challenges in accessing courts were noted such as members of the community having limited awareness on the existence of equality courts as a form of legal recourse when their rights to equality is violated. This is also evident from the lack of complaints lodged with the equality courts monitored.

The SAHRC Eastern Cape provincial office will be hosting a stakeholder engagement with relevant government departments and civil society organisations in order to ventilate challenges in effectively utilizing equality courts. Further, the stakeholder engagement will identify the various forms of interventions needed to ensure that equality courts are functional and communities are aware of their function as a recourse for relief when their equality rights are violated. The stakeholder engagement will be held as follows:
