Media advisory: Call for submissions in respect of the Commission’s investigation into the alleged practice of “blacklisting” of former employees by mining houses in the North West Province

Over the years, the Commission in the North West has received complaints and enquiries relating to persons who allege they have been “blacklisted” from securing employment by their former employers.
Historically, the Commission addressed such complaints and enquiries by referring the affected persons to one of the entities that specialise in the recruitment processes of individuals in the mining sector in the North West. However, to date, the Commission is not aware of any person whose name has been cleared by the “blacklisting” agencies.

There is a lack of clarity on how the “blacklisting” system works, the parties involved throughout the value chain and the redress mechanisms available to persons affected by this practice. Given the above and the impact of unemployment on the enjoyment of other rights, the Commission in the North West has decided to investigate this issue at a systemic level.

As part of its investigation, the Commission is calling on former employees who have been adversely affected by the practice of “blacklisting” by the mining houses in the North West Province and any other interested parties to submit information to the Commission which may be relevant to its investigation of this matter. The information submitted may include information on the “blacklisting” practice as understood by the affected former employees, how it works, the parties involved, the rationale for the practice and its impact on the affected persons.
