Media Advisory: SAHRC Commissioner Jonas Ben Sibanyoni to lead an engagement to address land rights, indigenous communities’ concerns and illegal mining activities in the Namakwa district

The South African Human Rights Commission (the Commission) in the Northern Cape Province will be conducting a stakeholder engagement to address a range of pressing issues pertaining to land rights, indigenous communities' concerns, and the alleged illegal mining activities within the Namakwa district.

The stakeholder engagement has been organised to address several key concerns, including but not limited to:

•    Alleged illegal mining activities - the Commission has been made to understand that there are concerns regarding alleged illegal mining activities in the Namakwa district municipality. While mining companies assert compliance with applicable laws, it is essential that these concerns are thoroughly examined to ensure that the rights and well-being of communities are protected.
•    Alleged lack of consultation with affected communities - reports suggest that there has been insufficient consultation with the affected communities where mining activities are proposed and taking place. The Commission recognise the importance of meaningful engagement with communities to address their concerns and ensure that their voices are heard.
•    Proximity of mining to residential areas – residents in the affected areas in the Namakwa district are concerned about the proximity of mining activities to their residential areas. This raises questions about the safety of homes, potential damage to houses, and the overall impact on the well-being of the community.
•    Intensity of mining activity - The intensity of mining activities across an area covering just over 19,000 hectares is a matter of great concern. There are fears related to the environmental impact, pollution, and potential risks associated with the intensity of mining operations.

The engagement is scheduled to take place as follows:

The Commission believes that the stakeholder engagement will not only provide a platform for discussions but also offer an opportunity to propose effective strategies and recommendations that ensure the protection of human rights, environmental responsibility, and community well-being.
