Media Statement: South African Human Rights Commission (SAHRC) calls for swift and thorough investigation into the killing of Imam Muhsin Hendricks

The South African Human Rights Commission (SAHRC/ the Commission) expresses deep concern over the tragic killing of Imam Muhsin Hendricks, widely known as world's 'first openly gay imam' who was fatally shot in Gqeberha, in the Eastern Cape on 15 February 2025. Details of his killing emerged via footage which was widely shared on social media over the weekend. The Commission extends its condolences to his family, friends,  and the communities he served.

Imam Hendricks was a pioneering advocate for equality and inclusion, particularly for lesbian, gay, bisexual, transgender, queer or questioning, intersex, asexual, and more (LGBTQI+) persons within faith communities. His work sought to create spaces of dignity and recognition for all, challenging discrimination and advocating for human rights within the framework of religious expression.

The SAHRC strongly condemns this act of violence and calls on law enforcement authorities to conduct a thorough and expeditious investigation to determine the motive behind his killing. Should it be confirmed that Imam Hendricks was targeted for his advocacy in support of the LGBTQI+ community, this crime would highlight the urgent need for the full and effective implementation of the Prevention and Combating of Hate Crimes and Hate Speech Act.

South Africa has made significant strides in enshrining the right to equality and non-discrimination, but targeted violence against marginalised communities remains a critical concern. The operationalisation of the Hate Crimes Act is important in ensuring that such acts are properly categorised, investigated, and prosecuted to send a clear message that hate-based violence will not be tolerated in our society.

The Commission will be monitoring and assessing the matter in line with its constitutional mandate to protect human rights, and the Promotion of Equality and the Prevention of Unfair Discrimination Act. As part of its oversight mandate, the Commission led by Commissioner Tshepo Madlingozi who is responsible for the Equality Focal Area and the Eastern Cape Provincial Office will be travelling to Gqeberha, this week to speak to the SAPS to determine the scope and status of their investigation. In addition, the Commission will also meet with the Imam’s family and LGBTQI+ activists to express its heartfelt condolences and solidarity.

The SAHRC calls upon all relevant authorities to prioritise this case, ensure justice for the late Imam Hendricks, and reaffirm South Africa’s commitment to protecting all individuals from discrimination and violence.

The Commission will closely monitor the police investigation and will have a watching brief in any eventual trial.
