The subpoena has been issued against the Mr David Msiza, the Chief Inspector of Mines in terms of section 15 of the South African Human Rights Commission Act 40 of 2013, following the Department’s ongoing failure to cooperate with an investigation into alleged human rights violations linked to mining activities in Mooinooi.
The investigation concerns community complaint relating to structural damage to homes caused by mining operations, air pollution, and associated health impacts, as well as broader social and environmental harms linked to mining in the area.
Despite repeated correspondence, the Department has not provided the information required to conclude the Commission’s investigation. The subpoena compels the Chief Inspector of Mines to appear before the Commission and respond to questions concerning the Department’s regulatory responsibilities, its oversight of mining operations, and its obligations to protect communities’ constitutional rights.
