Media Advisory: SAHRC Eastern Cape to hold subpoena hearing into water access failures in OR Tambo District Municipality

The South African Human Rights Commission’s (SAHRC/the Commission) Eastern Cape Provincial Office (ECPO) will convene subpoena proceedings involving the Executive Mayor and Municipal Manager of the OR Tambo District Municipality in the Eastern Cape Province. This follows persistent concerns regarding lack of access to clean and safe water in communities across the district. The proceedings are in line with the Commission’s constitutional mandate to promote, protect, and monitor the realisation of human rights in South Africa.

As the country’s independent watchdog on human rights, the SAHRC is tasked with assessing government compliance with constitutional and legislative obligations, particularly where failures in service delivery adversely affect the dignity, wellbeing, health, and socio-economic rights of vulnerable communities.

The Commission has, over a sustained period, monitored and engaged with concerns affecting residents within the OR Tambo District Municipality, including communities in areas such as Flagstaff, Mqanduli, Ingquza Hill, Port St Johns and King Sabata Dalindyebo Local Municipality.

Communities have reported prolonged lack of access to potable water, reliance on unsafe water sources, and failures in existing infrastructure despite the installation of water systems in certain areas. The Commission has conducted oversight visits, inspections and extensive engagements with the Municipality in an effort to secure remedial interventions and accountability.

Despite correspondence, requests for information, follow-up engagements, and escalation to relevant authorities, concerns remain unaddressed including the adequacy of responses, implementation of proposed interventions, and continued non-responsiveness to the Commission. These subpoena proceedings are intended to obtain explanations under oath, assess the adequacy of planning, budgeting, implementation and oversight mechanisms, and facilitate accountability in relation to the ongoing impact on affected communities.

The Commission regards access to sufficient water as central to the enjoyment of a range of constitutionally protected rights, including dignity, equality, life, health, and an environment not harmful to health and wellbeing. The proceedings seek to strengthen accountability and support meaningful interventions aimed at ensuring the progressive realisation of these rights.
