The South African Human Rights Commission (the Commission) welcomes the Randburg Equality Court’s judgment, handed down on 8 June 2017, in the matter of Mkhondo & SAHRC v Vicky Momberg.  The Court has found Ms Momberg guilty of hate speech in terms of Section 10 of the Equality Act, and further found that Constable Mkhondo’s right to human dignity were infringed upon.

Child Protection Week is a precursor Youth Month, celebrated and recognised in South Africa.  The Constitution enjoins us all to act in the best interests of the child.

The South African Human Rights Commission is aware of an electronic communication currently being circulated that warns members of the public that, from today onwards, all calls will be monitored and all communications on WhatsApp, Twitter and Facebook and other forms of social media are being monitored by the police. It warns the members of the public not to forward any posts or videos they receive regarding politics and the present situation about the government. It suggests that there is a new communications law referred to as “Cyber Crime” allegedly being applied by the police to monitor to record phone communications, including on social media, and other electronic communications.

The 25th of April 2017 marks the 2nd anniversary of Africa Pretrial Detention Day, commemorated annually to raise awareness of the plight of thousands of people who are held in detention in police cells and prisons across Africa for prolonged periods without trial. The 25th April was chosen to coincide with the adoption by the African Commission on Human and Peoples' Rights of new Guidelines on Arrest, Police Custody and Pretrial Detention ('the Luanda Guidelines'). The new Guidelines provide a blueprint for States to strengthen national systems and practices in relation to arrest, police custody and pretrial detention. The Luanda Guidelines reinforce the importance of a criminal justice system built on core human rights principles.

The nation’s tragic loss comes at the end of Human Rights month, a stark reminder of what he and so many fought to realise.

Human Rights Day is commemorated annually on 21 March to honour the sacrifice of those who fell during the Sharpeville massacre on this day in 1960.

The Commission further notes media reports of a march against foreign nationals, planned to take place on Friday, 24 February 2017, in central Pretoria.

The South African Human Rights Commission (the Commission) is deeply concerned with reports of escalating incidents of violence directed at foreign nationals and of destruction of property. Media reports indicate that at least three houses were destroyed as a result of community violence in Pretoria West over the weekend and a further twelve had been destroyed in Rosettenville, Johannesburg in the preceding week. New reports indicate that thirty shops were damaged and looted in Atteridgeville and Lotus Gardens late on 20 February 2017.
