Western Cape SAHRC Provincial Manager, Lloyd Lotz on Smile FM discussing hate speech

The controversial pastor, Oscar Bougardt, has been ordered by the Cape High Court not to preach against homosexuality for the next two months, he is facing charges of hate speech and contravening a court order.
Bougardt has been hauled to court by the SAHRC. Bougardt landed in trouble in 2014 over homophobic remarks on social media and was ordered by a court order to refrain from publishing statements that are discriminatory or incites hatred or harm on the grounds of sexual orientation. Benito caught up with Lloyd Lotz: Western Cape SAHRC Provincial Manager, to tell us more about this case and hate speech in general. We learn of the process that the commission takes in declaring or pursuing a human rights violation case. The law provides a guideline for the commission especially in such cases where there might be conflicts between “morale” and “norm” in defining rights. Lotz highlights that people often forget that rights are accompanied by responsibilities and hence perpetrators find themselves in such situations. The case has been postponed to the 14th of May in order to allow the pastor to rally adequate legal representation. Click here to access the audio
