The commission approached the court following the dissemination of a recording in which Agrizzi is heard using the k-word at a meeting at his house.
He subsequently apologised.

At the directions hearing on this matter, the Randburg Magistrate Court made a number of directives which included an order directing parties to attend to resolving this matter amicably. It ordered that the parties should attend court today for a further directions hearing.

If a settlement is reached, it would be made on order of court Jones says.

I can confirm that we met with Mr Agrizzi's lawyers, on 13 June 2019, to discuss possible settlement options and negotiations were still ongoing yesterday. This morning, we will also have another meeting before the matter appears in court.

Jones adds that even though the SAHRC disagrees with the submission by Agrizzi's lawyers, they do have a point when they say that the recording was unlawful.
The recording was unlawful and intentionally recorded without Mr Agrizzi's knowledge nor his permission, in the privacy of his residence, in an attempt to persuade him not to whistleblow.
