Western Cape

Introduction:
The Western Cape Province is a melting pot with a rich cultural history. However along with this rich and diverse cultural landscape, socio-economic conditions, economic status, religion, politics, rural & urban mark numerous fault-line which characterize social divisions.  The province remains distinctly unequal with extreme wealth and deep structural poverty co-existing side by side. This context both informs and makes efforts to resolve human rights disputes challenging.


The stakeholder interventions were as follows:
20 year commemorative event: Africa Day with special focus on Xenophobia on 20 May 2015 in Zwelathemba, Worcester
Non-nationals: The rights and responsibilities of non-nationals at Belville, 28 July 2015
Gender: Gender abuse in the Western Cape at Atlantis on 24-25 August 2015

Louwville, Vredenburg, Saldanha Municipality, 1-2 September 2015
Beaufort West, Beaufort west Municipality, 21-22 September, 2015

Communications:
The Western Cape office engages regularly in media interventions included the print media, radio and television including two appearances in 2015 for Human Rights Day in March and International Human Rights Day in December on Expresso, morning television on SABC 3.

Nature of Complaints Addressed by this Provincial Office:
  • Freedom of expression – Hate speech complaints;
  • Equality – Race, sexual orientation;
  • Socio-economic rights: access to water and sanitation, pensions and grants and healthcare;
  • Arrested detained and Accused persons rights;
  • Access to housing complaints;
  • Right to education;
  • Alleged violations of the rights of children;
  • Complaints against various government departments including in terms of Promotion of Access to Information and Promotion of Administrative Justice Acts;
  • Labour relations complaints which are registered and referred to either the CCMA or the Department of Labour depending on the issues in dispute (this also includes alleged workplace discrimination disputes);
  • Freedom and security of the person complaints.
Achievements:
  • Equality Court judgments by agreement including following mediation:
  • Bougardt matter (complaint against a pastor posting statements amounting to hate speech on social and other media);
  • Sunette Bridges matter (complaints against Ms Bridges for encouraging racially offensive statements amounting to hate speech on social media);
  • Coulson matter (complaint of discrimination regarding the refusal of guest house owners to afford a same sex married couple accommodation due to their sexual orientation);
Court judgments:
