Magor must face Equality Court over racist rant- SAHRC

22 May 2023

The legal subcommittee of the South African Human Rights Commission has recommended that Belinda Magor, the white woman behind the racist WhatsApp voicenote calling for black people to be killed and their genitals removed, be taken to the Equality Court. Commissioner Andre Gaum told Sowetan a full body of commissioners of the SAHRC would meet on Thursday to decide on the recommendation after the settlement negotiations between the commission and Magor failed.
Gaum said the commission sent Magor a letter in December, but said he would not disclose its contents. He said the commission had asked Magor to apologise for racist utterances she made in November 2022 but it was not satisfied with her apology. "The commission still needs to approve the recommendation and if the recommendation is approved, we will file our papers in the Equality Court. It is our duty as the commission to protect human rights and we need to send out a strong message against acts of hate speech," said Gaum. Magor was arrested in November and is facing a charge of crimen injuria. Magor is set to appear at the Boksburg magistrate's court on May 24. National Prosecuting Authority spokesperson Phindi Mjonondwane said Magor appeared at the Benoni magistrate's court on April 25 and was released on warning until her next court appearance. Sowetan called Magor yesterday and last week but her cellphone went to voicemail. Magor's landlord told Sowetan last week that she vacated his property after an eviction Belinda Magor SUPPLIED order he issued to her in November. He could not say when did Magor leave. Magor's voicenote was shared in the WhatsApp group for pit bull owners called Pitbulls Be My Voice. The group had over 300 members from different races across the country. In the voicenote, she could be heard saying that black men were "worse than pit bulls". Her outburst came during a discussion about the spate of attacks by pit bulls on children, which led to some people calling for a ban of the breed as pets. She blamed her outburst on diabetic medication she had been taking. Meanwhile, Gaum said the commission was still investigating the WhatsApp voicenote of Randfontein farmer Abel Erasmus, who made racial slurs and threatened to kill black people after a robbery at his house in December. On Christmas Eve, Erasmus "mistakenly" shared a racist voice note where he repeatedly referred to black people as "houtkop k*****s". The recording was sent to a WhatsApp group known as "Koop and Verkoop" with more than 200 members of the farming community of Vleikop. In the message that made the rounds in January, Erasmus threatened to shoot "k******s" in their private parts if they ever set foot on his property again.
