The South African Human Rights Commission (the Commission) is committed to upholding and advancing the right to food security, as enshrined in Section 27 of the Constitution of the Republic of South Africa. This provision states that every citizen is entitled to sufficient food and water. Furthermore, the Constitution imposes a constitutional duty on the state to enact legislative and other measures to progressively realise the right to sufficient food by taking reasonable steps to ensure its full enjoyment. While this right is progressively realised for all citizens, it is an absolute right for children to have access to basic nutrition, as outlined in Section 28(1)(c) of the Constitution.

Section 184 (1) (c) of the Constitution empowers the SAHRC to monitor and assess the observance of human rights throughout the country. This includes inspecting areas of potential violation and seeking redress where necessary.

It holds deep significance in South Africa's history as it marks the Soweto Uprising of 1976, where many young people lost their lives protesting against the compulsory teaching of Afrikaans in black township schools by the Apartheid regime.
