On 26 February 2015, the Deputy Chair of the African Union’s Committee of Experts on the Rights and Welfare of the Child (Committee), Prof. Julia Sloth-Nielsen briefed the South African Human Rights Commission (Commission) on the Concluding Recommendations by the Committee following the discussion of South Africa’s Initial Report on the Status of the implementation of the Charter on the Rights and Welfare of the Child. The Committee is part of the African Union and the meeting has been hailed as a significant step because it marks the beginning of a laudable effort by the Region to effectively give recognition to the work of National Human Rights Institutions.

The South African Human Rights Commission (the Commission) is extremely concerned about the constitutionality and impact of the provisions of the Emolument Attachment Orders (“EAOs”) as articulated in the Magistrates Court Act 32 of 1944(MCA) on the poor, the vulnerable, the marginalized amongst other groups including, but not limited to, the pensioners and women.  In terms of the EAO a person’s salary, may be attached should they be in arrears and fail to make alternative arrangements regarding the settling of the debt. These attachment orders can be done by a Clerk of the magistrates’ court without the judicial oversight of a magistrate.

“The South African Human Rights Commission (the Commission) received a complaint from Professor Lotz relating to a 2008 Carte Blanche programme which broadcast pictures of his deceased daughter’s body. The programme was broadcast without prior notification to the parents and caused them both severe distress and trauma.
