On the occasion of the commemoration of the Human Rights Day, on 21 March 2013 we as a Human Rights Commission sees this as that opportunity to reflect on the achievements or otherwise in the development of a culture of human rights in South Africa since the inception of democracy in 1994.

The South African Human Rights Commission has noted with deep concern reports of the death of a taxi driver allegedly while in police custody. Media reports suggest that the 27-year-old man, a Mozambican national, was the victim of police brutality after he was allegedly assaulted by police officials from Daveyton police station, tied behind the back of a police van, and dragged to the nearby police station.

The right to a basic education is a constitutionally protected right that is unequivocally guaranteed to all children in South Africa. It is considered a central facilitative right that is not qualified by expressions such as ‘available resources’, ‘progressive realisation’, or ‘reasonable legislative measures’ which are applicable to other socio-economic rights enshrined in our Constitution. This was explicitly confirmed in the 2011 Constitutional Court Judgement of Governing Body of the Juma Musjid Primary School and Others v Essay NO and Others.
